Article 1. APPLICATION AND OPPOSABILITY OF THE GENERAL CONDITIONS OF SALE

These General Conditions of Sale (hereinafter “GTC”) are those of Dzelle, a simplified joint-stock company with a capital of 15,714 euros, whose head office is located at 20 Avenue Longchamp 57500 Saint-Avold, registered with the Trade Register and the SARREGUEMINES Company under number 804 048 551 (hereinafter “Dzelle” or the “Seller”).
Any reference to “us” or “our” within the framework of these GTC means Demoizelle and any reference to “you” or “your” designates you as a user of the Site.
These GTCS apply as soon as you access the www.demoizelle.fr online store (the “Site”) or place orders to purchase one or more products. presented on the Site. Sales made through any other physical or online store, are not governed by these GTCs.
The GTCs are subject to change at any time at the sole discretion of the Seller. The GTCs applicable to any order placed through the Site are those in force on the date the order is placed. By checking the box “I have read and I accept the general conditions of sale”, you declare having read the GTC and having accepted them before ordering online, so that any order placed on the Site necessarily implies irrevocable acceptance of the GTC, without restriction or reservation on your part.

Article 2. CONDITIONS OF PURCHASE

The Site offers a selection of products (hereinafter the “Product (s)”) for online sale via the Internet and for delivery to mainland France and internationally.

Article 3. AVAILABILITY OF PRODUCTS

Subject to the Seller’s consent, the Product offers presented on the Site are only valid as long as they are online. Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders of the same Product by several customers. In the event of unavailability of a Product after placing your order, Customer Service will contact you as soon as possible, offering you the option of placing the order on hold for delivery of the missing item, or to deliver only the Products available, to order another Product presented on the Site as a replacement or to cancel your order.
The Seller cannot be held responsible if Products are unavailable and reserves the right to change at any time, without prior notice, the Products offered on the Site.

Article 4. PROCEDURE OF ORDER

Article 4.1. Create your account
To place an order on the Site, you must create your online account and provide valid and up-to-date personal information: last name, first name, telephone number, email address and delivery address. You guarantee that all personal information communicated to DEMOIZELLE is accurate.
Your identifiers are confidential and must not be communicated to third parties. Consequently, any purchase made using your identifiers will be deemed to be made by you as the holder of these identifiers.

Article 4.2. Order
The choice and the purchase of a Product are placed under your responsibility as the purchaser. The photographs, graphics and descriptions of the Products on the Site are only indicative and in no way binding on the Seller. DEMOIZELLE cannot be held responsible for any variation in the presentation of the Products between the Site and the Product delivered.
When you choose a Product, you must select a size and click on the “Add to cart” button. You can then decide to continue your purchases or consult your basket to place an order. To order, click on “My basket”.

Article 5. PRICES, TAXES AND DELIVERY COSTS

All prices indicated on the Site are in euros, VAT included. DEMOIZELLE reserves the right to modify the prices at any time and without notice. All costs of connection to the Site, including Customer Service, as well as the cost of any telephone communication, including any additional costs for the operator, and the cost of postage for any mail addressed to DEMOIZELLE for whatever the reason, is your responsibility.
Delivery is offered by DEMOIZELLE with no minimum purchase amount required.

Article 6. PAYMENT

The accepted payment methods are: Carte Bleue, Visa, Mastercard.
You must be the holder of the bank card used. The payment area made available is a dedicated space, which ensures the security and recording of the payment order. This space is responsible for the storage and automated processing of information relating to the payment of each order, including the details of the bank cards used.

Article 7. DELIVERY

Unless temporarily unavailable, the Products purchased will be delivered to the address indicated when ordering on the Site within 5 to 10 working days, following receipt of payment of their price by DEMOIZELLE. The deadlines communicated by DEMOIZELLE are only indicative.
Delivery costs are offered by DEMOIZELLE. However, the consequences resulting, where applicable, from the erroneous and/or incomplete nature of the information provided by you for delivery (late delivery, impossibility of delivery, additional transport costs, etc.) will be at your expense.
If you notice an anomaly during delivery (damaged package, missing product, etc.), this must be the subject of a handwritten reservation on the delivery slip.

Article 8. TRANSFER OF OWNERSHIP AND TRANSFER OF RISKS

The transfer of ownership of the Products will only take place after full payment of their price. The transfer of risk, on the other hand, will take place on delivery, that is to say at the time of delivery of the Products to the delivery address you have given us.

Article 9. RIGHT OF WITHDRAWAL – RETURN – EXCHANGE

You have a period of fourteen (14) days from the day after receipt of the Product (s) ordered to exercise your right of withdrawal, without having to provide any reason or to return or exchange all or part of the Product (s) received.
To do this, you must inform us with your decision through an unambiguous declaration:
• – On the Site, in the “My Account” section, by clicking on the “ Return ”, then by selecting the order number and the Products concerned or;
• – by post (only for the right of withdrawal), by sending the withdrawal form accessible here to:

Return costs are borne by DEMOIZELLE utilizing a return label to be affixed to your package, a label that we will send you by email exclusively.
You must return the products no later than fourteen (14) days after having communicated your decision to withdraw the Product (s), in its (their) packaging and its (their) original packaging, in new condition and insert the return notice communicated by email in the packaging.
Provided the conditions above are respected, DEMOIZELLE will reimburse the amount of the Product (s) returned within fourteen (14) days from the day on which your decision to withdraw has been brought to the attention of DEMOIZELLE. However, following article L121-21-4, the Seller reserves the right to defer reimbursement until receipt of the returned Product (s) or until receipt of proof of shipment of the returned Product (s) ( s). DEMOIZELLE will reimburse using the same means of payment as that used for the initial transaction.
In the event of an exchange, any new delivery can only take place after the receipt by DEMOIZELLE of the returned Product (s) ( s) and the payment of the balance, if the value of the Product requested in exchange is greater than that of the Product (s) returned. Payment for the new sale will be made by offsetting the amount of the previous sale, it is understood that any overpayment will be refunded to the bank card used for the purchase. The delivery costs of the Product (s) requested in exchange will be borne by DEMOIZELLE. However, if these new Product (s) do not give you satisfaction, the new return costs will not be borne by DEMOIZELLE.
In any case, any damaged Product (damaged, worn, stained, incomplete, etc.) returned to the Seller cannot be the subject of a refund or an exchange.

Article 10. CONFORMITY AND GUARANTEE

You must ensure that the Products delivered correspond to your order. If this is not the case, you must inform Customer Service as soon as possible and return the Products in question under the conditions set out in Article 9 of the GTC. The Products are subject to the warranty conditions provided for by law to the exclusion of all other warranties.
Thus, the seller is liable for any lack of conformity of the goods with the contract under the conditions of Article L. 211-4 and following consumer code, and hidden defects of the product sold under the conditions provided for in articles 1641 and following of the civil code.
When acting as a legal guarantee of conformity, the consumer:
• – benefits from a period of two years from of the delivery of the good to act;
• – can choose between repair or replacement of the good, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
The legal guarantee of conformity applies regardless of any commercial guarantee granted.
The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with in article 1644 of the civil code.

Article 12. ELECTRONIC FILES AND PROTECTION OF PRIVACY

You have an individual right of access, withdrawal and rectification provided for by law and can in this regard delete information concerning you that is no longer relevant, by making a request by email or by post, to contact details mentioned in article 12.

Article 13. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights attached to the Products and the Site, including brands, models, photographs, illustrations, logos, copyrights and patents, remain the full and exclusive property of DZELLE. Any total or partial reproduction, modification or use of these brands, models, photographs, illustrations, logos, copyrights and patents, for any reason and on any medium whatsoever, is strictly prohibited.

Article 14. DISPUTES AND APPLICABLE LAW

The GTCs are subject to French law. In the event of a dispute between the parties relating to the execution or interpretation of these GTC or, in general, the relationship between the parties, they will endeavour, as a first step, to settle the dispute amicably. that opposes them.
